Grand Theft Charges in Florida

Grand theft is theft of property worth $750 or more, and it is a felony. How serious the felony is depends mostly on value, and value is something the State has to prove.

What are the grand theft value levels?

Property worth $750 to under $20,000 is a third-degree felony. $20,000 to under $100,000 is a second-degree felony. $100,000 or more is a first-degree felony. Certain items are grand theft whatever they are worth, including a firearm and a motor vehicle. Each degree carries a different maximum prison term, and restitution is usually ordered on top.

Can the value of the property be challenged?

Value means the fair market value at the time of the theft, not what an owner says it was worth or what it cost new. Used property, items that were returned, and property with disputed ownership all raise questions. Moving a case down a bracket can change the entire outcome.

How do intent and ownership matter?

Many grand theft cases come from disputes: a loan that was not repaid, a business relationship that fell apart, a vehicle one person thought was theirs, or a misunderstanding with an employer or family member. Taking property you honestly believed was yours, or had permission to use, is not theft. The State must prove intent.

What is restitution?

If property was returned or can be paid for, that often changes how the State and the judge see the case. I will talk with you before any money changes hands, because payments and statements can be used against you.

What about theft from an employer?

Accusations against employees often come with an internal investigation. If you have been asked to meet with HR or a manager about missing money or property, call me before you say anything.
